Terms of Service

These Terms of Service ("Terms") govern your access to and use of Hark (the "Service"), operated by Gideon Codeworks LLC ("we," "us," or "our"). By creating an account, you agree to be bound by these Terms.

1. Service Description

Hark is a software-as-a-service platform for dog-services professionals (trainers, groomers, walkers, boarders) to manage clients, schedule sessions, generate contracts, send invoices, process payments via Stripe Connect, and communicate with their clients.

2. Account Registration

You must provide accurate information when creating an account. You are responsible for all activity under your account and for keeping your credentials secure. You must be at least 18 years old and legally capable of entering into a binding contract.

3. Subscription + Payment

Access to Hark requires a paid subscription after the free trial period. Fees are billed in advance monthly or annually, as selected. Prices are listed on our Pricing page. We reserve the right to change pricing with at least 30 days' notice. Fees are non-refundable except where required by law.

4. Payment Processing

Payments from your clients to you are processed by Stripe, Inc. under Stripe's terms of service. You are responsible for maintaining your Stripe Connect account in good standing. We do not take custody of client funds. Standard Stripe fees apply (currently 2.9% + $0.30 per card transaction); Hark takes no additional fee on client transactions at launch.

5. Your Content + Data

You retain ownership of all data you input into Hark (client records, dog profiles, session notes, templates, etc.). You grant us a limited license to store, process, and display this data as necessary to provide the Service. You may export your data at any time. If you cancel your account, we will retain your data for 30 days in a read-only state before deletion, unless you request earlier deletion.

6. Prohibited Use

You agree not to:

Use Hark for any illegal purpose or in violation of any applicable law
Resell or sublicense the Service to third parties
Attempt to reverse-engineer, decompile, or extract source code
Spam, phish, or send unsolicited communications through Hark
Upload malicious content or interfere with other users' use
Falsely represent your identity or affiliation

7. Dog Training Content Disclaimer

Hark provides tools; it does not provide dog training services, veterinary advice, or legal advice. Contract templates, email templates, and other content provided by Hark are starting points only. You are responsible for the accuracy and legal sufficiency of any contract, invoice, or communication you send through Hark. We strongly recommend having an attorney review any contract template before using it with clients.

8. Service Availability

We aim for 99.9% uptime but do not guarantee uninterrupted access. Scheduled maintenance will be announced in advance when possible. We are not liable for downtime caused by Stripe, Vercel, Neon, or other third-party service providers we depend on.

9. Termination

You may cancel your subscription anytime via the billing portal. We may suspend or terminate your account for violation of these Terms, non-payment, or other reasonable cause with written notice.

10. Limitation of Liability

To the maximum extent permitted by law, Hark's total liability for any claim arising from your use of the Service is limited to the amount you paid us in the 12 months preceding the claim. We are not liable for indirect, consequential, or punitive damages, including lost profits or lost data.

11. Changes to Terms

We may update these Terms from time to time. We will notify you of material changes via email at least 30 days before they take effect. Your continued use of Hark after changes take effect constitutes acceptance.

12. Governing Law

These Terms are governed by the laws of the State of Ohio, USA, without regard to conflict-of-laws principles. Any dispute will be resolved in the state or federal courts located in Cuyahoga County, Ohio.
